1. Acceptance of Terms
By accessing and using the Rocker IT Leadership Academy community and related services (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service. The Service is operated by Rocker.io ("us", "we", or "our").
2. Description of Service
The Service is an online community and educational platform designed for IT professionals. It provides access to educational content, tools, resources, and a peer network for professional development. The Service may be offered with various membership tiers, including free and paid subscriptions.
Resources and course materials are released progressively over time. Not all content may be available immediately upon subscription, as we continuously develop and add new materials to enhance member value.
3. User Accounts & Registration
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during the registration process
- Update such information to keep it accurate, current, and complete
- Safeguard your password and maintain the security of your account
- Notify us immediately of any unauthorized use of your account
You are responsible for all activities that occur under your account.
4. User Conduct & Content
You are solely responsible for all content (text, images, data, etc.) that you upload, post, or otherwise transmit via the Service ("User Content").
You agree not to:
- Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
- Upload, post, or transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships
- Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," or any other form of solicitation
- Harass or interfere with another user's use and enjoyment of the Service
We have the right, but not the obligation, to monitor and remove any User Content that we determine in our sole discretion violates these Terms or is otherwise harmful to us, our users, or any third party.
5. Intellectual Property
All content provided by us as part of the Service, including text, graphics, logos, images, audio clips, digital downloads, data compilations, course materials, tools, templates, and software, is the property of Rocker.io or its content suppliers and is protected by international copyright laws.
Your License:
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial professional development.
Prohibited Uses:
You may not reproduce, duplicate, copy, sell, resell, redistribute, or otherwise exploit the Service or any part of it for any commercial purpose without our express written consent. This includes, but is not limited to:
- Downloading materials with the intent to cancel your subscription
- Sharing access credentials with non-members
- Distributing course materials, tools, or resources outside the platform
- Creating derivative works for commercial purposes
User Content:
User Content remains the intellectual property of the individual user. By posting User Content on the Service, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, primarily for the purpose of operating and promoting the community.
6. Fees, Payments, and Refund Policy
Certain aspects of the Service may be provided for a fee ("Paid Services"). If you elect to use Paid Services, you agree to pay all applicable fees and charges.
Refund Policy:
Paid memberships are non-refundable once you have accessed or downloaded any course materials, tools, templates, or other resources provided through the Service. This policy protects the intellectual property and time invested in creating these materials.
Specifically:
- No refunds will be issued if you have accessed, viewed, or downloaded any premium content, including but not limited to courses, tools, templates, worksheets, or other digital resources
- Trial period abuse: If you sign up for a paid plan with a trial period and access or download materials with the intent to cancel before being charged, you forfeit any refund rights and may be charged the full subscription fee
- Exceptions: Refunds may be considered only if you have not accessed any materials and contact us within 48 hours of purchase, or as required by law
Pricing Changes:
We reserve the right to change our pricing and to institute new charges at any time, upon notice to you, which may be sent by email or posted on the Service. Existing subscribers will be notified at least 30 days before any price changes take effect.
7. Termination
Our Rights:
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to:
- Breach of these Terms
- Fraudulent activity or abuse of trial periods
- Unauthorized sharing of content or access credentials
- Violation of intellectual property rights
Your Rights:
If you wish to terminate your account, you may discontinue using the Service or cancel your subscription through the platform's settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.
8. Disclaimer of Warranties
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the use of the Service will be accurate or reliable
- Any errors in the Service will be corrected
9. Limitation of Liability
IN NO EVENT SHALL ROCKER.IO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Kentucky, United States, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Kentucky, and the parties hereby consent to personal jurisdiction and venue therein.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.
Notice of Changes:
We will provide notice of material changes by:
- Updating the "Last Updated" date at the top of this page
- Sending an email notification to the address associated with your account
- Posting a notice on the Service
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
